R. V J.R. Robbery + Assault and Uttering Threats (Vancouver Provincial Court)

Decision: Assault x 2 (Conditional Discharge

The accused was charged with a robbery and on another occasion with Assault and Uttering threats. Counsel advocated for a plea to the lesser-included offence of Assault to the Robbery.

The robbery charge was Stayed. Counsel exchanged the plea to the separate assault in order to have the Uttering threats charge Stayed. Counsel then set the matter for sentencing and detailed the accused aboriginal background to the court.

Counsel was successful in obtaining a conditional discharge for the accused, foregoing the entry of a criminal record.
